For the purpose of the General Data Protection Regulation (“GDPR”), “Dresden Partners”, is the data controller of your “Personal Information” and “Sensitive Information”, unless expressly specified otherwise.

5 How we use your Personal Information

“Dresden Partners” uses the “Personal Information” and “Sensitive Information” we collect from you for the following business purposes including but not limited to 

  • From the applicants: to identify and contact the applicant, create a file as a candidate or job applicant, consider and evaluate the candidate for a vacancy offered by “Dresden Partners”, carry out the recruitment, selection, and placement procedure, verify the information provided by the candidate, validate academic data, request and corroborate personal and work references, if required, carry out socioeconomic studies, make a comparison between the compensation and current salary of the candidate, carry out studies and psychometric evaluations, carry out interviews, If necessary, create a job offer, an individual employment contract and create a work file.
  • From actual or potential clients: provide our nearshore staffing and recruitment services of specialized personnel, provide technological support services, provide specialized services, provide personnel augmentation services, provide human resources administration and management services, send information regarding our services, submit quotes regarding our services, make a record in our customer database, make commercial contracts and comply with the obligations that we have acquired by those contracts, make and manage invoices.

 

We collect your “Personal Information” and “Sensitive Information” for the following commercial purposes

  • From the applicants: To keep you in our database, to be considered for future vacancies, to contact you to offer you open vacancies that match your profile, marketing, and mailing.
  • From clients or potential clients: Marketing, mailing, and commercial prospecting.

7 Legal basis for collecting and processing personal information

“Dresden Partners” collects and processes your “Personal Information” and/or  “Sensitive Information” based on different legal grounds, depending on the nature of the “Personal Information” and/or “Sensitive Information” provided and the purpose of the collection. 

  • Performance of a contract: Some of your “Personal Information” and/or “Sensitive Information” collected and processed by us is necessary for the performance of an agreement with you, for example; celebrating a job contract with “Dresden Partners” and/or a third party.
  • Legal Obligation: We collect and process your “Personal Information” and/or “Sensitive Information” to comply with various laws, for example, employee information required by diverse governmental bodies.
  • Legitimate interest: Processing “Personal Information” and/or “Sensitive Information” is necessary for legitimate interests pursued by us or by you. For example,  when you request more information about our services, pricing, and quotes, as well as for internal administrative operations such as payroll.

10 How to Exercise Your Rights

10.1 Under the CCPA

You may exercise any of your rights under the CCPA  by submitting a verifiable request to the following email address dataprivacy@dresdenpartners.com.

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your “Personal Information”. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  •  Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

 

We cannot respond to your request or provide you with “Personal Information” if we cannot verify your identity or authority to make the request and confirm the “Personal Information” relates to you. We will only use “Personal Information” provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Please note that we may require additional information to verify your identity and process your request. We will respond to your request within 45 days of receiving it, as required by the CCPA. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

10.2 Under the GDPR

  • Name and address, and any other means to communicate a response
  • Documents proving your identity
  • The clear and precise description of the specific privacy rights you wish to exercise in your request}
  • In the case of rectification requests, you must indicate the modifications to be made
  • The documentation that supports your request

 

Please note that we may require additional information to verify your identity and process your request. We will respond to your request within 30 days of receiving it, as required by the GDPR. Upon receiving your request, we will provide you with information regarding the actions taken in response to your request electronically. If your request is granted, we will provide you with the requested information or make the necessary amendments as per your instructions.

11 Data retention and deletion

We will keep your “Personal Information” and/or “Sensitive Information” as long as necessary to fulfill the purposes described herein. Upon your request, we will delete your “Personal Information” and/or “Sensitive Information”, unless we are legally permitted to or required to keep certain data, for example, to fulfill a legal obligation or to resolve a dispute, etc.

12 Security

At “Dresden Partners” we have implemented the security, technical, administrative and physical measures necessary to ensure the integrity of your “Personal Information” and/or “Sensitive Information”, and prevent its damage, loss, alteration, destruction or the use, access or unauthorized treatment. Only authorized personnel, who have complied with and observed the corresponding confidentiality requirements, may participate in your treatment.

12.1 Data Breaches

Despite our best efforts to secure your information if we suffer a data breach, we will do our best to reduce its effects and will follow the applicable notification provision of the CCPA and GDPR and any other applicable laws.

13 Sales of Personal Information or Right to Opt-out the sale of your Personal Information

The CCPA gives California residents the right to opt out from the sale of “Personal Information”. We do not sell, exchange for money, or other considerations of your “Personal Information” to third parties. We share information with third parties who work with us, as explained in previous sections, for the purposes described herein. 14 Children’s Privacy 

Our services are not intended for children under the age of 13. We do not knowingly collect personal information from children.
